Blanca Toledo Individually and as Next Friend of A.M.W., a Minor; and Juan Antonio Perez v. Hacienda Apartments, LLC and Laura Abundis; In the 288th Judicial District Court; Bexar County, Texas.

This case involved an abduction, sexual assault and rape of a minor child that occurred in a vacant unit of an apartment complex owned by our client. This case presented with significant hurdles, including evidence suggesting our client allowed “vacant” apartments to remain open with a history of units being improperly opened by outsiders and used as a “squatter’s place of abode”. Additional evidence of criminal activity (robberies and aggravated robberies) also hindered our client’s liability defense. We successfully tried case to a verdict of approximately 3% the total amount Plaintiff sought at time of trial. Plaintiff sought over $3 million at time of trial. $102,473.92 in favor of the Plaintiff plus court costs. Case tried by John Curney.
