Farmer, House, Osuna & Olvera Obtains Summary Judgment in Bexar County

Congratulations to Ruben J. Olvera for obtaining a summary judgment in a premises liability case filed in Bexar County, Texas.  Although the lawsuit was timely filed, the Defendant was not served with the citation until after the statute of limitations expired.  On behalf of his client, Ruben affirmatively pled a statute of limitations defense, and filed a Motion for Summary Judgment asserting Plaintiff's lack of diligence in service of citation as a matter of law and that Plaintiff's claims were barred by the statute of limitations.  After considering the motion, the evidence and oral arguments, the Court granted summary judgment and dismissed Plaintiff's claims.
