This case involved a defendant driver with a blood-alcohol level of 0.27 and/or over twice the legal limit. Defendant was arrested for DWI at the scene and served a related criminal sentence accordingly. Plaintiff was a passenger in a vehicle rear ended by the Defendant. Plaintiff was alleging cervical and lumbar injuries, a life care plan, and future surgical fusion in connection with the accident. At time of closing, Plaintiff demanded $1,000,000.00 in damages. The jury returned a verdict awarding Plaintiff a portion of her past medical expenses of approximately $17,000.00. Furthermore, as to the bifurcated punitive damages phase, the jury awarded $10,000 in punitive damages. Award for the Plaintiff in the amount of $32,054.36. Case tried by Edward Osuna.
