Congratulations to Farmer, House, Osuna & Olvera and Partners Edward L. Osuna and Ruben J. Olvera in obtaining a defense-oriented verdict. This case involved alleged severe personal injuries as a result of a motor vehicle accident between a motorcycle and company vehicle. As a result of the accident, wherein it was alleged the company driver took an illegal left turn into oncoming traffic and failed to yield the right-of-way, the motorcycle driver sued the company driver and his employer for negligence and gross negligence. Plaintiff also contended that the company driver and the company violated numerous "safety rules," which was a danger to the community at large. In the Petition, the Plaintiff was asserting a maximum amount of damages of up to 50 million dollars.

As a result of the accident, the Plaintiff alleged a number of substantial permanent and serious injuries which were presented at trial by fact and expert witness testimony. Throughout the course of litigation, there were more than 35 total fact and expert witness depositions taken.

At trial, the Plaintiff presented alleged past and future pecuniary damages of more than 1.5 million dollars, and requested that the jury award more than 30 million dollars plus punitive damages. At the conclusion of the 3 week trial and after deliberating for approximately 5 hours, the jury returned a verdict of 1.7 million dollars and found that the company driver and company were only partially responsible based upon the percentages assessed. The jury was also unanimous in finding no gross negligence as to both the company driver and the company. Due to trial time negotiations prior to verdict, Plaintiff will not recover prejudgment interest or court costs in connection with the verdict, and the verdict is not subject to any appeal.
